The integrated platform portal.primariaclujnapoca.ro is a web platform developed within the project "Increasing decision-making transparency and simplifying administrative procedures for citizens - ANTO - CIIC, code SIPOCA 629/MySMIS 128473" financed by the Administrative Capacity Operational Program 2014-2020". The platform provides citizens with a series of electronic services that deal electronically with citizens' requests sent to departments within Cluj-Napoca City Hall, being available to all users of electronic devices with access to internet services.
  • ACCEPTANCE OF THE TERMS OF OPERATION
By using the portal.primariaclujnapoca.ro platform you accept these Terms and Conditions of Use. The Municipality of Cluj-Napoca may modify these Terms and Conditions of Use at any time, in order to improve the service. By continuing to use the portal.primariaclujnapoca.ro platform, after changes are made to these Terms and Conditions, you agree to accept those changes.
 
  • PURPOSE OF THE PLATFORM AND REQUEST FOR PERSONAL DATA
The portal.primariaclujnapoca.ro platform provides a modern and fast communication channel between citizens and the various departments within Cluj-Napoca City Hall in order to improve the quality of their services. That is why it is indispensable to identify as precisely as possible the details of the submitted request and the person who transmits the information. In this sense, two types of data can be identified that fall under the scope of personal data:
  • Access data in the application, necessary for the correct identification of the user as well as for the conclusion of remote contracts - surname, first name, e-mail, telephone (optional), CI (optional), CNP/CUI, address (optional)
  • Data collected by completing the steps, such as: identification data, field of activity, characteristics, details related to privately owned goods, files in different formats, which can be added within the steps
The user will become aware of the nature of the requested data when using the application.

When you use our website to search for certain services and to view the information we make available, we use a certain number of cookies (first party cookies) and third party cookies (third party cookies) to enable the functioning website, to collect useful information about visitors and to provide you with the best possible experience when using our website. The users of the information and data received are departments within the town hall for the purpose of correctly identifying the problem, as well as the appropriate resolution of the submitted request. The exchange of data with third countries or international organizations is not foreseen.
 
  • DATA RETENTION
We keep your personal data for the period in which they are necessary for the purpose for which we initially requested them, including in order to create the archive, according to the legislation in force, likely to improve the quality of local services.
 
  • LIMITATION OF USE OF THE APPLICATION AND CATEGORY OF USERS
The portal.primariaclujnapoca.ro platform is intended for people who have reached the age of 18, who have the knowledge and ability to use electronic devices and who assume responsibility for the correctness and validity of the details filled in the request. The transmission of erroneous, malicious, obscene messages may lead to the suspension of the right of access to the platform. Other categories of people can use the classic methods of contact with the municipal departments, displayed on the Cluj-Napoca City Hall website www.primariaclujnapoca.ro.
 
  • CONFIDENTIALITY AND SECURITY OF PERSONAL DATA
In accordance with EU Regulation 679/2016, the Municipality of Cluj-Napoca collects and processes personal data, in compliance with the principles mentioned below, for legitimate purposes, in accordance with the Terms and conditions of use of the portal.primariaclujnapoca.ro platform which includes both public information sections as well as secure online interaction sections.
Any information made available by you, collected, processed, transmitted by the municipality of Cluj-Napoca when you use the portal.primariaclujnapoca.ro platform is subject to the Privacy Policy of portal.primariaclujnapoca.ro, included in these Terms and Conditions of Use. Any attempt to use the personal data of another User is strictly prohibited, being considered an attempted fraud and will be sanctioned by contraventional or criminal law, as the case may be.
 
  • OBLIGATIONS REGARDING THE PROCESSING OF PERSONAL DATA
As a personal data operator, the municipality of Cluj-Napoca has the legal obligation to ensure:
  • Storing or transferring personal data only to local servers.
  • The inventory of personal data and the exclusive collaboration with service providers who in turn respect the rigors of the GDPR.
  • Keeping a record of personal data processing activities In accordance with EU Regulation 679/2016 for the protection of individuals with regard to the processing of personal data and the free movement of such data, the Municipality of Cluj-Napoca has the obligation to administer safely and only for the specified purposes those personal data that users provide when accessing and completing the registration forms available in the electronic services application.
  • Security and confidentiality of personal data In this regard, every effort will be made to ensure the use of the application by users under maximum security and confidentiality, with appropriate measures in place to ensure a level of security commensurate with the risks, including pseudonymization, encryption, the ability to ensure data confidentiality and integrity, the ability to restore data integrity in the event of physical or technical incidents. According to the notification procedure in the event of a breach of personal data security, notification of such an event will be made by request to the data protection officer at the institution level, at the email address: dpo@primariaclujnapoca.ro or by a complaint to the ANSPDCP .
 
  • YOUR RIGHTS ON PERSONAL DATA
As a personal data operator, the Municipality of Cluj-Napoca has the legal obligation to ensure to the data subjects the exercise of their rights over personal data in accordance with the provisions of the General Regulation (GDPR) 679/2016, art.15-22, the most important being:
  • The right to information and access to personal data, whereby you have the right to request a report of your personal data that we process
  • The right to rectification, whereby you have the right to ask us to correct or amend your incorrect personal data
  • The right to data erasure ("the right to be forgotten"), whereby you can ask us to delete your personal data in the event that the data is no longer necessary for the purpose for which it was collected or processed, you withdraw your consent based on which the processing takes place or you simply no longer wish to be in our database
  • The right to object to data processing, whereby you can object to the use of your personal data, with the possibility to desubscription, cancellation or revocation of the quality acquired through registration
  • The right to data portability, whereby you have the right to ask us to provide you with your personal data that we process with your consent, if this is technically possible.
  • The right to object to automated decision-making processes based on your personal information, if you have given us your consent; you have the right to object to such automated decisions and request that the decision be made by a person.
  • The right to lodge a complaint against the manner of personal data processing with the National Authority for the Supervision of Personal Data Processing

  • USE OF THE APPLICATION

Cluj-Napoca City Hall is not responsible for any error or omission occurring within the portal.primariaclujnapoca.ro platform, any failure, delay or interruption occurring within the portal.primariaclujnapoca.ro platform, any loss or failure resulting from the use of the portal platform. primariaclujnapoca.ro, any malfunction of your equipment through which you access the platform or any way of using the portal.primariaclujnapoca.ro platform by its users.   • COMPLAINTS

  • USE OF A LICENSED LANGUAGE
Any deviation outside the platform's object of activity, sending false requests, using obscene words, attacking the person, displaying ads or advertising messages, as well as uttering insults, trivialities and insults to people who have written a comment, or offers specialized answers on the portal.primariaclujnapoca.ro platform, will be sanctioned by partial censorship of the comment, complete deletion or even banning the right to use the application.
 
  • GENERAL

The platform is available to all citizens, users of electronic devices (computer, laptop, tablet) who want to benefit from municipal public services, without going to the town hall. Ways to access the platform: some services are accessible only by providing a valid email address, for others an account is required by filling in all the fields (some of them are optional). These data are used in communication with you in order to transmit the status of the submitted requests and how to solve them.
